Providing Services in Overland Park, Kansas

Overland Park is the second most populated Kansas city.  Considered a suburb of Kansas City, Missouri, Overland Park is within Johnson County next to the county seat of Olathe. The 13 mile city had a population of more than 173,000 as of the most recent 2010 census, and 8.7 percent of households include seniors 65 and older who live alone.  The city’s median age is 37.8, and 12.3 percent of all city residents are 65 and over.

Overland Park is the home of more than 40 different companies that have located their headquarters there. It is also the location of three general medical and surgical hospitals including St. Luke’s South Hospital, Menorah Medical Center, and Overland Park Regional Medical Center. Specialty hospitals including Heartland Surgical Specialty Hospital and Mid-America Rehabilitation Hospital are also located within Overland Park and there are more care facilities in neighboring Merriam.

Seniors and residents of all ages can benefit from estate planning services to protect their future, while everyone should have a healthcare directive and healthcare power of attorney in place to ensure they make medical decisions about treatment in advance of a serious illness or injury.

Senior Residents of Overland Park

According to Johnson County Kansas Human Services, there are more than 35 nursing homes located in the county, including several homes directly in the Overland Park area. While providing information about nursing homes, Human Services also offers information on applying for Medicaid.

Many people turn to Medicaid to pay for the cost of nursing home care because nursing homes are very expensive. Medicaid may require spending down assets because there are maximum income and asset requirements. However, Overland Park seniors can avoid the loss of money and property they have worked hard for by getting help with Medicaid planning.

In addition to nursing homes, many seniors in Overland Park can live in adult care homes or assisted living facilities, while others live independently either without assistance or with help from family members and/or home care aids.

The aging process can create new health issues and necessitate new help with activities of daily living. Overland Park elder law attorneys can assist seniors in finding all sources of financial support to cover these costs including VA benefits, private insurance, Medicaid, and Medicare.

Well elder law services are focused on responding to the unique needs of aging seniors, estate planning services are for everyone. It is also essential to ensure that assets are protected.

Estate planning and elder law services are aimed not only at helping you to build and secure a nest egg, but also at getting you and your family ready for anything life throws at you. From making advanced plans for medical care to deciding how retirement assets should be invested, elder law and estate planning attorneys in Overland Park offer many services to people of all ages. Some of the different ways in which we can help you include:

  • Creating a living will / advanced directive and power of attorney so you have control over types of life-saving medical care that will be provided to you.
  • Determining how much to invest in retirement, how to structure retirement investments, and what insurance coverage to secure to protect your future and your family’s future.
  • Creating wills and trusts and using other estate planning tools to minimize estate taxes, avoid probate, and ensure your heirs inherit the maximum property they can in a timely manner.
  • Determining who should be named as a guardian for minor children and how children and pets should be cared for in the event of a parent or owner’s untimely death.
  • Planning for the cost of long-term care in case nursing care or assisted living care becomes necessary
  • Assisting with the probate process, so heirs and executors can get the help they need as the affairs of an estate are wound up.

Parman & Easterday is well known for handling these issues, as well as other financial and practical matters that are necessary to achieve a secure future and care for yourself and your loved ones for a long time to come.

The Courts Where Estates are Settled in Overland Park

When property is owned in Overland Park Kansas, the property will generally transfer to heirs through the probate process. Estates must be settled in probate court after a death has occurred. Since Overland Park is located within Johnson County, estates are settled at the Johnson County Probate Court located at 100 North Kansas Avenue. The probate division is located within the Johnson County Court House, on the second floor. It is on the west side and the Clerk’s Office is open Monday through Friday between the hours of 8:00 AM and 5:00 PM.

Many people hope to avoid probate proceedings because probate can result in taxes being assessed on estates, and it can be a complicated and costly process. Parman & Easterday has provided comprehensive estate planning services to many clients in Overland Park that have made it possible for assets to be transferred outside of probate.

The probate division also handles guardianship proceedings, which occur if someone becomes incapacitated and family or friends need to have the individual declared a ward so his or her assets can be managed. These proceedings can also be stressful, but can be avoided if you work with an Overland Park attorney at Parman & Easterday to create a durable power of attorney or a living trust before incapacity occurs.
